Terms and Conditions

Measures Installed for Rebates

1. In order to receive the Round 3 rebate(s), Participant responsibilities are:

  • Step 1
    Identify Project
  • Step 2
    Obtain Project Bid from qualified contractor/trade ally clearly identifying existing equipment/fixtures and equipment/fixtures to be installed
  • Step 3
    Purchase and install eligible measure(s)
  • Step 4
    Submit Rebate Application after installation of equipment including copy of itemized and dated invoice plus Boulder County Utility Release Form/authorization.

2. By applying for this rebate, the Participant is not guaranteed a rebate, and this application does not constitute a rebate reservation. Rebates will be awarded on a first-come, first served basis.

3. It is the Participant’s responsibility to select and schedule a contractor to perform the work, and payment of such contractor’s invoice is the sole responsibility of the Participant, and not that of Boulder County or its representatives.

4. Participant hereby acknowledges that the EnergySmart/ Boulder County makes no representations or warranties for materials provided by or work performed by Participant’s contractors, vendors, consultants, or Participant’s own employees as applicable to measures installed.

5. Boulder County, and its agents and representatives, retain the right to visit and inspect the Participant’s property for the purpose of verifying that the deemed savings for which this Application is submitted have actually been achieved. Participant agrees that should Boulder County, or its agents and representatives, exercise this right and elect to inspect the property, Participant will authorize Boulder County to access the property to perform such inspection.

6. The Participant shall comply with all applicable federal, state, and local regulations, requirements, ordinances, and statutes.

7. Participant agrees to ensure that potentially hazardous or regulated wastes (e.g., PCB-containing ballasts, fluorescent lamps, high-intensity discharge lamps, etc.) are handled and disposed of in compliance with applicable federal, state, and local laws and regulations and shall be discarded in accordance with Boulder County’s EnergySmart Waste Management Plan, as amended from time to time available at: energysmartyes.com/Contractor/WasteManagement.pdf.

8. Participant will give permission for its local utility company to provide energy data to Boulder County by signing a separate waiver. The form can be accessed here.

9. Participant acknowledges that, in the event that a rebate is awarded, such proceeds may be funded in whole or in part by the American Recovery and Reinvestment Act of 2009 (the “Act”) and that as such Participant will take whatever steps are necessary to comply with and to ensure EnergySmart/Boulder County’s compliance with the requirements of the Act.

10. Participant acknowledges that it may be required to complete an IRS Form W-9, or otherwise provide its business taxpayer identification number, for Boulder County financial reporting purposes.

11. Rebate awards will be limited to one award per project, and will generally be limited to one rebate per parcel. However, EnergySmart/Boulder County may award rebates on multiple projects for a particular parcel if it is determined, within the sole discretion of EnergySmart/ Boulder County, that more than one project and corresponding rebate is merited for a particular parcel. The term “parcel” shall refer to an individual unit of real property that is designated as a unique parcel by the Boulder County Assessor and has accordingly been assigned a unique parcel number.

12. The participant certifies that it is not a Governmental Entity

13. Participant is a not casino or other gambling establishment, aquarium, zoo, golf course, swimming pool, or medical marijuana dispensary.

14. If the structure affected by this installation is more than 50 years old, is on the National Register of Historic Places, or is on the Colorado State Register of Historic Properties, you may still be eligible to receive a rebate, but the installation must be reviewed by Boulder County prior to proceeding with the work. If a measure is installed prior to receiving historic preservation clearance from Boulder County, the Participant assumes the risk of not receiving a rebate. In no event shall historic preservation clearance from Boulder County be construed as a reservation or guarantee of a rebate.
